1. Acceptance

By accessing or using leadnurturix.com, its free tools or our services, you agree to these Terms of Service. If you do not agree, do not use the site. You confirm that you are at least 18 and are using the site for business purposes. If we sign a separate written agreement with you, that agreement prevails over these terms for the services it covers.

2. Our services

We provide cold email infrastructure setup, B2B lead generation, copywriting, outreach management and related services. Scope, price, timeline and deliverables are agreed in a written proposal or agreement before work starts. Anything on this website is general information and is not an offer until confirmed in writing.

3. No guarantee of results

Outreach results depend on your offer, audience, list quality, sending practices, domain and mailbox reputation, and platform rules, many of which we do not control. We do not guarantee replies, meetings, sales, revenue, inbox placement or any other outcome. Examples, estimates and calculator figures are illustrative only.

4. Your responsibilities and lawful use

• You are responsible for making sure your outreach, your offer and your lists comply with all laws that apply, including CAN-SPAM, CASL, GDPR and PECR, and similar rules in the places you contact.
• You must have the right to contact the people you ask us to contact, use accurate sender identity and subject lines, and include a working opt-out in every campaign.
• You must honor opt-outs and complaints promptly and give us accurate information and timely approvals.
• You are responsible for the content of your offer and the claims it makes.

5. Prohibited uses

• Sending unlawful, deceptive, harassing, fraudulent, phishing, malware or impersonating messages.
• Promoting illegal goods or services, adult content, scams or anything else that platforms or providers prohibit.
• Using our services or tools to harvest data, spam, or harm others or any network.

6. Suspension and termination

We may pause or stop work immediately, without liability, if we reasonably believe these terms are breached, if a campaign harms deliverability or draws complaints or blacklisting, or if a provider suspends an account. You may end the services by written notice. Work already delivered and costs already incurred remain payable.

7. Fees and payment

Fees are as agreed in writing. Third-party costs such as domains, mailboxes and sending tools are billed at the provider's rates and are non-refundable once purchased. Unless your written agreement says otherwise, fees for work already started or completed are non-refundable. Overdue amounts may lead to suspension of services.

8. Third-party platforms

Domains, mailboxes, sending platforms, data sources and other tools are provided by third parties under their own terms. We are not responsible for their outages, limits, policy changes, suspensions or bans, or for any resulting loss.

9. Free tools

Our free tools (including the calculator, record checkers and generators, DNS lookup, Spam Checker and Anti-Spam Fixer) are provided as is for general guidance. Results are estimates, may be incomplete or out of date, and are not professional, legal or security advice. Do not rely on them alone for important decisions. Do not abuse them with automated or bulk requests.

10. Acceptable use of the website

• Do not attack, scan, probe, overload or attempt to gain unauthorized access to the site or its infrastructure.
• Do not scrape the site, reverse engineer it or copy it without permission.
• Security testing requires our prior written permission. To report a vulnerability, email Sales@LeadNurturix.com.

11. Intellectual property

The website, its design, text, tools and branding belong to LeadNurturix. We grant you a limited, revocable license to use the site and tools for your own business. Unless agreed otherwise, ownership of custom deliverables passes to you once they are paid for in full. We may reuse general know-how and non-confidential methods.

12. Confidentiality

Each party will keep the other's non-public business information confidential and use it only for the services, except where disclosure is required by law.

13. Disclaimers

The website, tools and services are provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and uninterrupted availability, to the fullest extent permitted by law.

14. Limitation of liability

To the fullest extent permitted by law, LeadNurturix is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data, goodwill, deliverability, domain or mailbox reputation, blacklisting or account suspensions. Our total liability for any claim is limited to the fees you paid us for the relevant service in the three months before the claim arose. Nothing here limits liability that cannot be limited by law.

15. Indemnity

You will defend and indemnify LeadNurturix against claims, losses and costs arising from your content, your lists, your offer, your breach of these terms or your violation of any law or third-party right.

16. Events beyond our control

We are not liable for delay or failure caused by events outside our reasonable control, including provider outages, internet failures, platform policy changes, or acts of government.

17. Governing law and disputes

These terms are governed by the laws of Pakistan, without regard to conflict-of-law rules. Any dispute that cannot be resolved under the process below is subject to the courts of Pakistan, without limiting any mandatory rights you have where you live. Before any formal action, both parties agree to try in good faith to resolve a dispute by emailing Sales@LeadNurturix.com and allowing 30 days to respond.

18. Changes

We may update these terms. The date at the top shows the latest version, and continued use of the site means you accept the changes.

19. General

If part of these terms is unenforceable, the rest stays in effect. Failure to enforce a term is not a waiver. These terms and any written agreement are the entire agreement on their subject.
